1. Acceptance of Terms
By accessing or using the website at sunnysideseed.com (the "Site") or by engaging Buffalo Erosion & Sediment Control ("we", "us", "our") for services, you agree to these Terms & Conditions. If you do not agree, please discontinue use of the Site and our services.
2. Services
We provide erosion and sediment control services — including silt sock installation, silt fence installation, and straw blowing — primarily in Buffalo, NY and the surrounding Western New York region. All services are subject to a separate written estimate or work order, which forms the binding agreement for the work.
3. Quotes & Pricing
Quotes provided through the Site, by email, or in person are estimates based on the information available at the time. Final pricing may be adjusted to reflect actual site conditions encountered during installation, including but not limited to soil conditions, trenching feasibility, access constraints, and weather. Material increases or scope changes will be communicated before additional work proceeds.
4. Site Access & Conditions
The client is responsible for providing reasonable site access during scheduled work windows, identifying the location of any underground utilities, and ensuring the work area is free of hazards that would prevent safe installation. We use 811 markings and reasonable visual inspection but cannot be held responsible for damage to unmarked utilities or undisclosed site features.
5. Compliance
Installations are performed in accordance with the NYSDEC Standards and Specifications for Erosion and Sediment Control, applicable municipal requirements, and any project-specific SWPPP. The client remains responsible for the overall stormwater management plan, ongoing inspections, and final regulatory compliance.
6. Payment
Payment terms are stated on each individual estimate or work order. Late payment may incur interest as permitted under New York law. Disputes regarding work performed must be raised in writing within ten (10) business days of completion.
7. Warranty
We warrant that installations will be performed in a workmanlike manner consistent with industry standards. We do not warrant that any installation will prevent all sediment movement under all weather conditions, and we are not responsible for damage caused by extreme weather events, third-party site activity, or failure to maintain installations after handoff.
8. Limitation of Liability
To the maximum extent permitted by law, our total liability arising out of or related to any service or use of the Site is limited to the amount paid by the client for the specific work in question. We are not liable for indirect, incidental, consequential, or punitive damages.
9. Use of the Site
You agree not to use the Site for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Site. You may not attempt to gain unauthorized access to any portion of the Site.
10. Intellectual Property
All content on the Site — including text, graphics, logos, photographs, and software — is the property of Buffalo Erosion & Sediment Control or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without prior written permission.
11. External Links
The Site may contain links to third-party websites. We are not responsible for the content, privacy practices, or policies of those sites.
12. Changes to These Terms
We may update these Terms at any time. The "Last updated" date at the top of this page reflects the current version. Continued use of the Site or our services after changes are posted constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of the State of New York. Any dispute arising under or related to these Terms shall be resolved in the courts of Erie County, New York.
